Participants will learn about how proffers have evolved in Virginia, how this fits within the broader legal framework on unconstitutional conditions in the U.S., what the key provisions are in SB 549 (2016), and what the potential consequences are for the practice of land use planning and regulation by Virginia's local governments.

SB 549 introduced substantial uncertainty for planners, who are now unsure about whether their formal practices and even informal communications with regard to development conditions could expose the local government to legal action.
